Mediation to Stay Married


Anyone who’s ever been in a serious relationship knows how hard it can be to keep things on the rails. When couples fail to properly address these relationship problems, this can lead down the long, painful track of divorce.

However, a relatively new movement in the mediation space reflects the sanctity of marriage, and a commitment to those vows. Many times, couples use mediation to help them resolve the issues that affect their divorce. This new movement, called Mediation to Stay Married, is the alternative for couples that are experiencing problems, but want to stay married.

Mediation to Stay Married differs from Marital Mediation, which is slightly different in that the objective of Marital Mediation is unclear and may ultimately lead to the decision to get a divorce. Mediation to Stay Married, on the other hand, is mediation that a couple can choose with the goal of staying married in mind as the primary objective.

With Mediation to Stay Married, the couple will see a mediator who will use dispute resolution techniques to help get through difficult periods and to improve couples’ communication skills.

Different than martial therapy, Mediation to Stay Married helps assess the legalities of certain situations. For instance if a dispute resolves around a financial dispute, a mediator with legal training can help the couple clearly understand where the law stands on the issue. This can also be true for family law issues such as custody and child support, as well as larger issues as they pertain to business dealings, home ownership, tax, wealth and estate planning. In any case, it is not an alternative to marital therapy for those experiencing severe problems in their relationships.

Often, the result of Mediation to Stay Married is an agreed upon written agreement, but this may not always be the case. This is often called a Postnuptial Agreement, but the law is currently unclear in most states as to the enforceability of these agreements. Still, it is an option to remain a written documentation of the reasoning and outcomes that transpired during the session.
